The noise caused by the military planes on Whidbey Island has been the subject of much controversy and diminishing property values. A Whidbey Island home buyer sued Windermere Real Estate, as the listing agent, for failing to give adequate notice of the level of noise inflicted on the home. The suit was made under the Consumer Protection Act and was dismissed by the trial court. The Court of Appeals, Division I, overruled the trial court and reinstated the lawsuit. In so doing the Court expanded consumer protection law and rendered listing agents more responsible to buyers.
